Sprinkles vs. Famous Cupcakes: "Silly Cupcake Wars"

Take Apart calls the Sprinkles vs. Famous Cupcakes lawsuit "a sugary story of ridiculousness." General sentiment seems to agree. They have photographic evidence too:

It’s a giant sprinkle. If your cupcakes taste good you should have nothing to worry about. Also - like I said - IT”S A GIANT SPRINKLE. I mean I know we live in a day and age where branding is super important, but when it comes down to it, the people that would mix the two companies up aren’t coming to shop for your name anyways, they’re probably coming because they want some cake and you’re nearby.

But I digress. What we should really be talking about is how people pay upwards of 4 dollars for a little piece of cake with a giant sprinkle on it.. Seems super silly to me.

I say, bake your own cupcakes and put whatever design on it that you like.

Other sources are taking advantage of the Sprinkle Cupcake vs. Famous Cupcakes Lawsuits. Some websites have a video about Famous Cupcakes listed on their website. These websites are taking advantage of the fact that the public is interested in the lawsuit filed by Sprinkles cupcakes. Astonished web users will be stunned when instead of a Famous Cupcake video installing, there computer downloads a virus and Spyware disguised as a program which is supposed to allow you to see the video.

My Computer Downloaded a Virus from Famous Cupcakes Video

Curious, I did a web search for "Famous Cupcakes". After clicking onto one of the websites, I clicked continue when the website wanted to download software to "get the video to work" and "install components Windows needed to view the video". After I clicked continue, I realized one second too late that this was a bad idea. The website I visited had already begun installing a virus and Spyware onto my computer.

I am rolling around on the floor at the idea of a cupcake lawsuit! No doubt the law firms will have to do lots of tasting and the judge will want the jury to carefully munch over all the evidence! I'd so love to get on that jury! t.x

I do agree that if the logo is too similar that's a cause for concern and Sprinkles should protect that, but the decoration? Sorry, Sprinkles, you weren't the first to use fondant decors, even the dot in the middle. I loved the comment "it's just a giant sprinkle!" Food decoration CAN NOT be copyrighted - the logo and name can be trademarked, photos can be copyrighted, but the design itself? No.

I actually live across the street from Famous Cupcakes in North Hollywood. It has barely been there a year. They passed out flyers, but I never took the time to go in because I was already addicted to Sprinkles Cupakes in BH, but when I heard about this lawsuit, I went over to the store to check out all the fuss. It took me a whole 15 minutes of sheer concentration to figure that Sprinkles is pissed because Famous uses dots on the brochure behind the logo. WTF? Really Sprinkles? Don't be petty. Have faith in your product. I was a loyal Sprinkles customer simply because they tasted great, not because of the dots (they are hard and don't taste good and are really a poor way of distinguishing one cake from another), and even though one of your competitors practically opened up on my frontyard, I wasn't swayed by the use of dots in their logo. But I am swayed by how much of a MEANGIRL Sprinkles is being. Shame on you! I can't support a diva. In my world neither company will win...I am going to go to YummyCupcakes in Burbank from now on.
