Sprinkles goes to court

The Sprinkles vs. Famous Cupcakes case goes to court today. From KTLA:

Popular Los Angeles cupcake retailer Sprinkles will ask a judge on Monday to order rival pastry purveyor Famous Cupcakes to drop the dot motif it uses in its packaging and store decor and on its website.

In a trademark infringement suit filed in the U.S. District Court in August, Sprinkles accused the Valley Village-based Famous Cupcakes of stealing its trademark circle-on-a-circle design to lure customers away.

Sprinkles says Famous has never responded to its repeated requests to stop using the trademarked design. It will ask U.S. District Judge Perry Anderson to find that Famous has ignored its complaints and to order that it stop using the dot design.

Sprinkles' concentric dots were federally trademarked in April 2007, an attorney said.

According to the suit, bakeries in the U.S., Great Britain, and Asia have used the design, but stopped after they were asked to by Sprinkles.

Hi, I'm starting a cupcake business and the name I wanted to use had the word sprinkle in it...After reading this article I got a bit scared... Should I think of something else or is it OK to have "sprinkle" within my new name... Please help... :)

Well the woman who owns Sprinkled Pink is being sued by Sprinkles. And a bakery on the east coast called Sprinkle Sprinkle was forced to change their name by Sprinkles. I think you are opening yourself for a major lawsuit and harassment.
